The television broadcasting service, as a means of distance communication without the use of conductors, has been included among the subjects subject to state reserve since 1910; subsequently the reserve was extended to all telecommunications services, regardless of the route used (rd 645/1936; dpr 156/1973, "single text in postal matters").

In 1974 the Constitutional Court criticized the current public monopoly regime and affirmed the need to put some fundamental principles in the regulation of the broadcasting service, among which: the objectivity and completeness of information, with wide openness to all cultural currents; impartial representation of the ideas expressed in society; the independence of the public service manager from the executive power; information pluralism; the regulation of advertising programming (sent. 225 and 226). In 1975 there was the first organic law in the radio and television sector (103/1975), which, incorporating the principles already established on the subject by the Constitutional Court, characterized the television service as an essential public service. More specifically, the art. 1 of the law established that «the circular diffusion of radio programs over the air or, on a national scale, by wire and television programs over the air, or, on a national scale, by cable and by any other means constitutes, pursuant to art. 43 of the Constitution, an essential public service of a pre-eminent general interest, in that it aims to broaden the participation of citizens and contribute to the social and cultural development of the country in accordance with the principles enshrined in the Constitution ". The aforementioned legislation, therefore, recognized and justified the public monopoly in the broadcasting service, reserving it to the State for its pre-eminent general interest. Through the concession instrument, the State then attributed it to a public company, as a company of national interest, pursuant to art. 2461 cc (➔Italian Rai-Radio Television ). In order to implement the objectives, the principles indicated and to monitor radio and television services, an ad hoc parliamentary commission was also provided (from Legislative Decree 428/1947), called Parliamentary Commission for the general direction and supervision of radio and television services. Composed of 40 members, appointed by the presidents of the two Houses of Parliament, among the representatives of all parliamentary groups, the commission had, among its functions, that of formulating the general guidelines of the programs, of establishing the rules for access to the broadcasting medium, to indicate the general criteria for the formation of annual and multi-year spending and investment plans, to report to the Parliament, with an annual report, to elect 10 directors of the public concessionaire.
